The NBA legend Testifies He Felt No Fear of the Racing Body in Legal Battle

The basketball icon, as he cordially introduced himself in a Charlotte court on Friday, stated that his competitive side and status as a newcomer emboldened his push for 23XI Racing to “challenge” Nascar over perceived violations of competition laws.

Financial Stakes and a Competitive Drive

The owner disclosed financial and corporate details of his racing venture, saying he invested $40m of his personal wealth into the Cup Series operation co-founded with business partner Curtis Polk and driver Hamlin.

“Someone had to step forward,” Jordan said in the Charlotte courtroom. “I was a new person, I had no fear. I felt I could challenge Nascar as a whole. From my perspective, the sport required examination from a different view.”

The Core Dispute: Charter Agreements and Renewal Demands

The heart of the case involves the expiration of a 2016 deal where Nascar granted each team a franchise. This system mirrors other major leagues with separately owned franchises, like the Charlotte Hornets or the NFL’s Panthers. This deal was set to expire in 2024 when Nascar insisted on charter membership renewals.

Jordan testified for about sixty minutes and exited the courthouse to a media frenzy, with fans and media clamoring for a glimpse or a photo of the sports legend.

Leading the Legal Charge

23XI Racing is at the forefront of the push along with Front Row Motorsports for Nascar to change a business model Jordan contended is unlawful to keep two hands on the wheel.

At issue for Jordan and Heather Gibbs, who testified before Jordan, are events from last September. She recounted a hectic and tense period where the racing circuit informed teams they must sign a contract extension. This agreement consists of over a hundred pages outlining team compensation and a guaranteed spot in Nascar-sponsored races.

Choosing Litigation

Jordan said that his team and its ally decided their only feasible option was to decline to sign that extensive document and litigate the matter. The other 13 organizations agreed to the terms.

Jordan and co-owner Denny Hamlin approached Nascar about potential amendments or negotiations. Nascar wasn’t talking, according to his testimony.

The Ultimate Motivation: Winning

But in the end, the pushback against what he saw as a unsustainable system was driven by the usual bottom line for Jordan: Winning.

“Denny convinced me getting a third driver boosted our odds of winning,” he said, noting that he bought a third charter last year for $28 million despite the uncertainty. “So I took the plunge.”

Heather Gibbs’ Testimony

Gibbs described her push for indefinite franchises, submitted in a written letter to Nascar. She said the pressure of the contract signing demand was problematic.

She said, the team founder first tried to call and talk Nascar out of forcing signatures, but CEO Jim France declined the request.

“Don’t do this to us,” Heather Gibbs said was the message to Nascar’s executives. The response was, “If I wake up and I have 20 charters, I have 20. If there are 30, that’s the number.”
